1. Scope of Services
We provide construction, renovation, and related services as outlined in our project proposals, contracts, or agreements. Any additional work outside the scope must be agreed upon in writing and may incur additional charges.
2. Project Estimates and Payments
Estimates:** All project costs are estimated based on the information available at the time. Final costs may vary due to unforeseen conditions or changes requested by the client.
Payments:** Payments are due according to the schedule specified in the contract. Non-payment may delay or halt work.
Deposits:** A deposit may be required before commencing work, which is non-refundable unless otherwise specified.
3. Changes and Modifications
Any changes to the project scope or design must be agreed upon in writing and may affect the project timeline and cost. We reserve the right to adjust pricing based on changes.
4. Project Timeline
We will provide an estimated timeline for project completion. However, delays due to weather, supply chain issues, or other unforeseen circumstances are outside our control. We will notify you of any significant delays.
5. Permits and Regulations
We will obtain necessary permits and ensure compliance with applicable building codes and regulations, unless otherwise specified. The client is responsible for providing access and necessary approvals.
6. Liability and Insurance
We maintain appropriate liability insurance. However, we are not liable for damages caused by factors outside our control or for damages to existing structures not identified prior to work.
7. Warranties
We warrant that our work will be performed in a professional manner and in accordance with industry standards. Warranties for materials or equipment are subject to manufacturer policies.
8. Ownership and Risk
Ownership of materials transfers to the client upon full payment. Risk of damage or loss passes to the client once the work is completed and accepted.
9. Termination
Either party may terminate the contract with written notice. In case of termination, the client shall pay for all work completed up to the termination date.
10. Dispute Resolution
Any disputes shall be resolved through negotiation, mediation, or arbitration, as agreed upon in the contract. Legal action may be pursued if necessary.
11. Governing Law
These Terms are governed by the laws of New York, NY.
12. Miscellaneous
Entire Agreement:** These Terms, along with your contract, constitute the entire agreement.
Amendments:** We may update these Terms periodically. Changes will be posted on our website and communicated to clients.
Severability:** If any provision is deemed unenforceable, the remaining provisions shall remain in effect.
